Privacy Notice

PBP Abogados, S.C. (hereinafter “PBP” and/or the “Responsible”), a civil society validly constituted and existing in accordance with the laws of Mexico City, United Mexican States, with address located at Montes Urales 755, Floor 3, Colonia Lomas de Chapultepec, Mayor's Office Miguel Hidalgo, C.P. 11000, Mexico City, provides this privacy notice in compliance with articles 15 and 16 of the Federal Law on the Protection of Personal Data Held by Individuals and its regulations (hereinafter the “Law”). The personal data that you (the “Owner”) have provided directly or through electronic means to PBP, has been collected and will be treated by PBP under the principles of lawfulness, consent, information, quality, purpose, loyalty, proportionality and responsibility, in accordance with the provisions of the Law, and PBP is responsible for the use and protection of your personal data.

PBP may collect personal data, including sensitive personal data, necessary to provide any type of service that you request or require, in particular legal services. By way of example, but not limited to, PBP may collect your name, address, date of birth, country and entity of birth, nationality, fixed or cell phone numbers; email addresses, Unique Population Registration Code (CURP), Federal Taxpayer Registry Key (RFC), Financial Data and Business and Personal Property Data, for which the Owner grants his express consent. In the same way, such personal data may be transferred to third parties, whether physical or legal, national or foreign, for the sole purpose of fulfilling the purposes indicated in this privacy notice.

Your personal information will be used for the following purposes: to provide the legal services you have requested; to notify you about new services that are related to those already purchased; to communicate about changes in them; to prepare studies and programs that are necessary to determine preferences in the services provided; to carry out periodic evaluations of the services we provide in order to improve their quality; and in general, to comply with the obligations we have contracted with you.

To prevent unauthorized access to your personal data and to ensure that the information is used for the purposes set out in this privacy notice, we have established various procedures to prevent unauthorized use or disclosure of your data, allowing us to treat them properly.

If you wish to exercise your rights to access, rectify and cancel your personal data, as well as to object to their processing, revoke or limit their use or disclosure, through the procedures we have implemented, you can exercise the above-mentioned rights at any time (i) by sending your request by sending an email to info@pbpa.mx or, where appropriate, by email addressed to the person responsible for the Department of Personal Data Protection, located at Montes Urales 755, Floor 3, Colonia Lomas de Chapultepec, Miguel Hidalgo Mayor's Office, C.P. 11000, Mexico City, which contains in the subject of the same “Rights of Access, Rectification, Cancellation and Opposition” and in the body of the email what you want to do, either access, rectify, cancel or object, from 9:00am to 5:00pm from Monday to Friday on business days, as appropriate; to comply reliably with your request, you must let us know the personal data that you want to be rectified, canceled, revoked or revised and generally meet the requirements set out in article 29 of the Act; or (ii) through its registration in the Public Registry to Avoid Advertising, which is managed by the Federal Consumer Attorney's Office (“Profeco”). The foregoing, on the understanding that the cancellation of personal data will be subject to the provisions of article 26 of the Act.

On the other hand, we inform you that your data may be transferred and processed by individuals, national or foreign, other than PBP, with the general objective of fulfilling the purposes for which you have provided your data.

If we do not obtain your express opposition for your personal data to be transferred in the manner and terms described above, we will understand that you have given your tacit consent to do so.

This privacy notice may be modified by PBP, such changes will be promptly informed by email, on the PBP website, by telephone, or any other means of communication that PBP determines for this purpose.

Notwithstanding the foregoing, you can revoke your consent to the processing of your personal data at any time by sending your request via email to info@pbpa.mx, however, it is important to keep in mind that, for certain purposes, the revocation of your consent may mean that PBP is unable to continue providing the service you requested, or the termination of your relationship with PBP. You should also consider that not in all cases we will be able to respond to your request or stop using it immediately, since it is possible that due to a legal obligation we may need to continue processing your personal data for an additional period of time.

Notwithstanding the foregoing, if you consider that your right to the protection of your personal data has been injured by any conduct or omission on our part, or you presume a violation of the provisions of the Law, you can go to the National Institute for Transparency, Access to Information and Protection of Personal Data (“INAI”). In accordance with the above, it is understood that the Owner has consented to their personal data being processed for the purposes and in accordance with the guidelines contained in this Privacy Notice.
